TERMS AND CONDITIONS

All Goods are not supplied on a trial basis. Faulty goods will be refunded or replaced upon request. Battery Works retains the right to test the goods prior to replacement or refund.

Please notify us of any damages or order discrepancies within 7 days of receipt for a refund less postage/carriage and handling. Please see our "Returns Policy".
All prices and offers are subject to availability.

We do not charge credit cards until goods are available for dispatch. In instances where items are out of stock and delivery will be delayed, Battery Works will notify customers of the situation immediately.

You have the right to cancel your order or part thereof at any time except in cases where the goods ordered are for special importation or custom manufacture for the customer by Battery Works.  See the separate right to cancel policy.

We reserve the right to refuse to sell to any customer at our discretion.

TITLE AND OWNERSHIP OF GOODS

Where goods are supplied on credit or where cheques for payment are presented and not honoured by the customer’s bank then a clear title to the goods supplied will only pass to the customer when payment has been cleared and paid in full. Until such time of full payment Battery Works retains ownership of the goods.
Until such time as payment is received in full for the goods the customer is only a bailee of the goods and any proceeds from the sale of such goods is held in trust for Battery Works.

In this instance Battery Works retains the right to recover the goods by requesting the return of the goods or entering into the premises where the goods are situated to take possession of the goods or to take legal action to recover the goods.   

GUARANTEES AND WARRANTY

Battery Works goods and products carry a twelve month warranty from the date of consumer purchase. Any claim under this warranty must be made within 12 months of the date of purchase of the product by the consumer.

To make a claim under this warranty, the customer or consumer should take the product (with proof of purchase) to the store where the product was purchased or contact Battery Works.

Battery Works will pay reasonable, direct expenses of claiming under this warranty. You should submit details and proof of your expense claim to Battery Works for consideration. Battery Works when contacted may also give reply paid instructions for the return of the goods.

This warranty is provided in addition to other rights and remedies a consumer has under law: Our goods come with guarantees which cannot be excluded under Australian Consumer Law.

All customers are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. Battery Works customers are entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to be a major failure.

SHIPPING OF GOODS

Battery Works is committed to providing fast service in all shipping and endeavours to deliver goods the next day after order subject to stock being available. Repacking work is delivered immediately after completion of the work order. The turn-around time for repacking is generally between one and two weeks.

Brisbane, Gold Coast, Sunshine Coast and Toowoomba destination goods are delivered by fast local courier service. All other goods are delivered by fast overnight services using Australia Express Post or by overnight Air service bags and parcels.

Where hazardous goods restrictions apply then rapid road transport carriers are used.
Battery Works does negotiate excellent volume rates to keep all freight costs as low as possible for its customers.   

RETURNS POLICY

Battery Works is committed to ensuring you and your customers are completely happy with the goods purchased.

However, if you are not completely satisfied with your purchase please follow the procedure below

1. Phone the sales team at Battery Works to inform them of any problems which may be able to be fixed (1300 138 033 – local call)

2. Keep all materials shipped and return within 30 days of invoice date.

3. A credit will not be issued against the goods returned without prior authorisation. Postage/freight is excluded. The Battery Works sales team will give instructions for the return of faulty goods under a free reply paid return basis.

4.Depending on the reason for the goods return,  should the goods or the packaging be damaged when returned, then Battery Works retains the right to charge a “restocking fee’’ which will be expressed as a percentage reduction of the original sales amount.

RIGHT TO CANCEL ORDER POLICY

You have the right to cancel orders for whatever reason within 7 working days from the date you receive the goods. An exemption to this is when we import or manufacture and supply goods made to your own specification or personalised for you.

PRIVACY AND SECURITY

The Battery Works website is designed so that all information relating to sales transactions and customers details are collected and stored by Battery Works but this information is not able to be sourced by others through the website or in the data information held by the company.
Battery Works does not ask for, store or collect any sensitive information that does not relate to the sales transaction, an application for credit, or an enquiry for goods to be supplied. All information stored on the company’s data files is judged to be with the consent of the customer and will be kept in a secure and confidential manner.

No customer information will ever be given, sold or traded to outside parties. Battery works may use the customer information from time to time to issue product catalogues, advise on new products or pricing or to disseminate information to customers.  Customers may request to unsubscribe from receiving marketing information by contacting our sales team by phone or email.  ([email protected])

Some customer information may be supplied to others when subpoenaed by the force of Court legal action or when requested by the customer in writing. The customer will be advised of such action before information is supplied.

Customers may request information on their own personal data held by Battery Works and that request should be in writing to Battery works addressed to the General Manager, Battery Works, PO Box 362, Clayfield, Qld 4011.

Privacy information matters should be addressed to the General Manager, Battery Works.

TRADE PRACTICES ACT AND FAIR TRADING

The terms and conditions of sale of the goods supplied by Battery Works will always conform to the provisions of the Commonwealth Trade Practices Act 1974 or the Fair Trading Acts in each of the States and Territories of Australia, except to the extent permitted, where applicable, by those Acts.
